Privacy Policy

At Dar Al-Miyah we treat discretion as part of the service, and that begins with how we handle your data. This policy explains what information we collect when you contact us or browse this site, what we use it for, and what control you keep over it.

1. Data controller

The controller of your personal data is Dar Al-Miyah SARL AU, a single-member limited liability company incorporated under Moroccan law, with registered office at 183, Avenue Prince Héritier, Centre NREA, ground floor, unit no. 13, 90000 Tangier (Morocco), and registered in the Tangier Commercial Register under number 171897 (ICE 003879278000094, IF 71776961). 2. What data we collect

We collect only the information you provide voluntarily and that which is generated technically as you browse the site.

Property management form

When you entrust us with a property, we collect your full name, email address, phone or WhatsApp, city, and the details of the property: type, number of bedrooms, condition, current use, your goal as an owner and the description you write. You may optionally attach photographs of the property.

Acquisition form

If you are looking for a property, we collect your full name, email address and, if you provide them, phone or WhatsApp, preferred location, budget range and your specific interests or vision.

Browsing data

Our server records the IP address, browser type, selected language and pages visited. This data is used to keep the site secure and functional.

3. What we use your data for, and on what legal basis

• To respond to your enquiry and prepare a proposal. Legal basis: the application of pre-contractual measures requested by you.
• To assess a property and prepare a management mandate. Legal basis: the performance of a contract or the steps leading to it.
• To present you with opportunities that match your search. Legal basis: your consent, which you may withdraw at any time.
• To meet tax, accounting and anti-money-laundering obligations. Legal basis: compliance with legal obligations.
• To keep the site secure and prevent fraud. Legal basis: our legitimate interest.

We do not take automated decisions producing legal effects concerning you, nor do we build profiles for that purpose.

4. Who has access to your data

We do not sell your data or share it for commercial purposes. The following will access it, strictly to the extent necessary:

• Our web hosting provider, which holds the site and its backups.
• The business management system where we record enquiries and the property catalogue.
• Our legal, tax and notarial advisers, when a transaction requires it.
• The competent public authorities, where there is a legal obligation.

5. International transfers

Our activity is carried out in Morocco, where processing is governed by Law 09-08, promulgated by Dahir no. 1-09-15 of 18 February 2009, and is declared to the National Commission for the Control of the Protection of Personal Data (CNDP). To deliver the service we rely on providers established in the European Union and in the United States — web hosting and domain registration, email and cloud storage, and booking and communication platforms — among them Google LLC, Meta Platforms, Airbnb and Namecheap; these transfers are declared to the CNDP, arise from the performance of the contract or from the pre-contractual steps you ask us to take, and are protected by each provider's contractual clauses and by access restricted to authenticated accounts. Morocco does not benefit from an adequacy decision of the European Commission, so transfers originating in the European Economic Area additionally rely on the standard contractual clauses approved by the Commission.

6. How long we keep your data

We keep enquiries that do not lead to a contractual relationship for a maximum of two years, in case you get back in touch. If we do formalise a mandate, we retain the documentation for the duration of the relationship and the subsequent statutory limitation periods. Photographs of properties that do not result in a mandate are deleted when the enquiry is closed.

7. Your rights

You may request at any time access to your data, its rectification or erasure, the restriction of or objection to its processing, and the portability of the information you have provided to us. Where processing is based on your consent, you may withdraw it without affecting the lawfulness of processing carried out beforehand.

To exercise any of these rights, write to salam@daral-miyah.com, the address of Dar Al-Miyah's administrative office, stating which one you wish to exercise. We will respond within one month. If you believe we have not handled your request properly, you may lodge a complaint with the competent supervisory authority: the Spanish Data Protection Agency if you reside in Spain, or the Commission Nationale de Contrôle de la Protection des Données à Caractère Personnel (CNDP) in Morocco.

8. Cookies

This site uses technical cookies necessary for it to function and to remember the language you have selected. These do not require consent. If we add analytics or advertising cookies in the future, your prior consent will be requested through a specific notice and you will be able to manage it from that same panel.

9. Security

We apply technical and organisational measures to protect your information against unauthorised access, loss or alteration: encryption in transit, access restricted by role and regular backups. No system is infallible, but we handle your data with the same care with which we look after the houses in our charge.

10. Changes to this policy

If we amend this policy, we will publish the updated version on this page with a new date. Where a change substantially affects how we handle your data, we will tell you directly.
